KW3LA Terms of Service

These Terms govern use of the public Zimbabwe KW3LA pilot.
1. Who we are and what KW3LA does
KW3LA is operated by Rospop Labs Ltd, incorporated in England and Wales under company number 14542843, registered office 5 Brayford Square, London, England, E1 0SG (“Rospop”, “KW3LA”, “we”, “us”). KW3LA provides digital matching, account, communication, safety-record and related platform services. Approved drivers provide the passenger transportation service to riders. During the Zimbabwe pilot, riders pay drivers directly unless the app expressly states otherwise. Nothing in these Terms changes responsibilities that mandatory law places on KW3LA, Rospop, a driver or a rider.
Riders should also read the Rider Terms, which explain the driver/rider transport relationship, direct payment, safety expectations and the intended role of KW3LA as the matching and communications platform.
Public commercial use is currently intended for the Zimbabwe pilot. Any United Kingdom functionality identified as test or pilot-test functionality is not an offer of a public UK transport service unless we expressly announce otherwise.
2. Eligibility and accounts
- You must be at least 18 years old and legally capable of entering into these Terms.
- You must give accurate, current information and use an account that belongs to you.
- Google sign-in is used to establish account identity. You are responsible for protecting access to your Google account and device.
- You must not impersonate another person, create fraudulent ride requests, manipulate location, abuse support, or interfere with the service.
We may refuse, restrict or suspend access where reasonably necessary for safety, fraud prevention, legal compliance, repeated abuse, non-payment of driver platform fees, or serious breach of these Terms. Where practical and safe, we will explain the reason and provide a route to contact us.
3. Ride requests, matching and the transport contract
A rider enters pickup, destination, operating area and a proposed fare. Sending a request makes it available for matching with eligible nearby drivers. A request is not a guarantee that a driver will be available or will accept.
When a driver accepts, the app identifies the matched driver and vehicle using information held by KW3LA. The rider should check the displayed vehicle and registration before boarding. A rider may decline to enter a vehicle or travel with a driver if they reasonably feel unsafe or the displayed vehicle/driver identity does not match.
The driver remains responsible for driving, route decisions made lawfully and safely, the condition and lawful operation of the vehicle, and the actual transportation service. KW3LA may provide maps, location, messages, status information or support, but those tools do not replace the driver's duty to drive safely or obey the law.
4. Fares and payments
The rider proposes a fare in the currency displayed for the selected pilot market. The agreed fare for the ride is the amount shown/accepted through the service or otherwise clearly agreed by rider and driver before or during the trip. During the Zimbabwe pilot, the rider pays the driver directly. KW3LA does not presently take the rider fare through the app.
Drivers pay a platform fee on completed rides. The current pilot rate shown in the application is 10% of the completed ride fare. The applicable rate is the rate clearly displayed to the driver before accepting/completing the relevant ride. Driver commission is governed additionally by the Driver Terms.
Do not pay a person claiming to represent KW3LA unless payment instructions are shown through an authorised KW3LA channel. For the Zimbabwe launch, authorised cash collection may be used for driver-to-KW3LA platform-fee settlement. Other digital settlement rails, including EcoCash or USDC on Solana, are available only when Driver Home expressly shows them as enabled. These are settlement methods for driver platform fees and are not rider-fare collection.
5. Cancellations, no-shows and incomplete trips
Our Cancellation & Refund Policy forms part of these Terms. During the launch pilot KW3LA does not charge riders a platform cancellation fee. A rider may cancel before the trip starts, including after a driver has been matched. Drivers may also cancel for legitimate operational or safety reasons.
Repeated fraudulent, abusive or deliberately disruptive cancellations may result in warnings or account restrictions. Any future cancellation charge will be disclosed before it applies and will be subject to applicable consumer law.
6. Safety and conduct
- Treat riders, drivers and KW3LA staff respectfully. Threats, harassment, violence, sexual misconduct, discrimination, theft, fraud and deliberate property damage are prohibited.
- Do not ask a driver to speed, overload the vehicle, drive while unsafe, carry unlawful items, or break traffic or transport rules.
- Seat belts should be used where fitted and required. Children and passengers needing special restraints must be transported only in accordance with applicable law and safe vehicle capacity.
- Drivers must not use the app unsafely while driving. Stop safely before typing or performing distracting actions.
KW3LA may retain ride lifecycle events, matched identity information, in-app communications and periodic location records for safety, support, dispute handling and lawful investigations as explained in the Privacy Notice.
7. Driver status and legal compliance
Driver approval in the app is an operational KW3LA approval, not a government licence and not a guarantee that a driver has complied with every legal obligation. Drivers must independently maintain all licences, permits, certificates, registrations, insurance and legal authorisations required for passenger transport. 8. Privacy, communications and electronic records
Our Privacy Notice explains how we process personal information. Our Cookie Notice explains secure session cookies, Google sign-in and local browser storage.
Operational phone, SMS, WhatsApp, email and in-app messages may be used to provide a requested ride, communicate safety information, administer an account or respond to support. We will not treat consent to necessary ride communications as consent to unrelated direct marketing.
Electronic records, including ride status, account events, messages and acceptance of these Terms, may be retained as evidence of transactions and safety events to the extent permitted by law.
9. Service availability and pilot changes
KW3LA is an early-stage pilot. Features may change, be unavailable, contain defects or be suspended for maintenance, safety, security, legal or operational reasons. We do not promise uninterrupted availability or a particular number of drivers or rides.
We may update these Terms. Material changes will be identified by a new version/effective date and, where appropriate, we will require renewed acceptance before further ride requests or driver activity.
10. Liability and consumer rights
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limits a rider's mandatory rights under applicable consumer law. Nothing excludes liability for fraud or fraudulent misrepresentation.
Subject to those mandatory rights, KW3LA is responsible for its own platform service and for losses that are a reasonably foreseeable result of our breach. KW3LA is not responsible for losses caused solely by a rider's or driver's unlawful conduct, false information, failure to follow safety instructions, or events outside our reasonable control.
Drivers remain responsible for the transportation they personally provide, but this allocation does not remove any legal duty that may independently apply to Rospop Labs Ltd or KW3LA.
11. Intellectual property and acceptable use
KW3LA software, branding, designs and platform content are owned by or licensed to Rospop Labs Ltd. We grant you a limited, personal, revocable right to use the service for its intended purpose. You may not copy, scrape, reverse engineer, probe, overload, bypass security, introduce malicious code or use the service to facilitate unlawful activity except to the extent a restriction is prohibited by law.
12. Complaints, disputes and governing law
Please use our Complaints & Disputes procedure first so we can investigate quickly. Consumer and regulatory rights remain available regardless of that process.
For the public Zimbabwe pilot, these Terms are governed by the laws of Zimbabwe, subject to any mandatory rights or jurisdiction that cannot lawfully be excluded. Nothing prevents either party from seeking urgent relief or using a competent regulator, consumer body or court.
