Driver Terms

Drive legally. Drive safely.

Effective 29 September 2026 · These Driver Terms supplement the KW3LA Terms of Service.

1. Driver relationship with KW3LA

You provide passenger transportation using your own vehicle or a vehicle you are lawfully authorised to operate. KW3LA provides technology for matching, communication, safety records and administration. You decide when to go online and which open ride request to accept, subject to safety and platform rules.

These Terms do not by themselves create employment, partnership, agency or a franchise relationship. Your legal status is determined by the facts and applicable law, and nothing in these Terms overrides rights or duties that law imposes.

2. Mandatory legal eligibility

Before carrying any KW3LA passenger, you must hold and maintain every licence, permit, authority, certificate and insurance required for the vehicle and passenger service you operate. This includes, where applicable, an appropriate driver's licence, operator's licence, vehicle registration/licensing, valid certificate of fitness and insurance covering the intended passenger-transport use.

You must immediately stop using KW3LA for passenger transport if a required licence, permit, certificate, registration or insurance expires, is suspended, is cancelled, becomes inaccurate, or no longer covers the service.

KW3LA approval is not a government licence. Our review of your profile or vehicle information does not replace your legal obligations or any inspection/approval required by public authorities.

3. Accurate profile and vehicle identity

Your legal name, phone number, city, vehicle make/model/colour/year, licence plate and other onboarding details must be truthful and current. Only the vehicle shown on your approved KW3LA profile may be used for a matched ride unless KW3LA has approved an updated vehicle.

Material vehicle identity changes may return your profile to pending review and take you offline until re-approved.

4. Going online and location

Going online means you are available to receive ride requests in the pilot market stored on your driver profile. KW3LA may maintain that availability for a limited session period. To support matching and safety, your device shares live location while you are online and periodic location records may be retained during an assigned ride.

Do not falsify, spoof or deliberately obscure location data. If your phone cannot provide reliable location, go offline until it can.

5. Accepting and performing rides

  • Review the pickup, destination, fare and other information before accepting.
  • Accept only when you can lawfully and safely complete the trip.
  • Use the matched rider information only to complete the relevant ride and handle legitimate support/safety issues.
  • Do not transfer an accepted ride to another driver or vehicle without KW3LA authorisation.
  • Confirm the correct rider and trip before starting.
  • Never drive while impaired, dangerously fatigued, distracted, overloaded or while the vehicle is unsafe.

Drivers must comply with traffic, road transport, public service vehicle, insurance and other applicable laws at all times.

6. Fares, cash and rider payments

During the Zimbabwe pilot, riders pay drivers directly. The driver is responsible for receiving and accurately accounting for the rider fare. Do not misrepresent the agreed fare, demand undisclosed platform charges, or use threats or coercion to obtain payment.

Where a trip ends early, use reasonable judgment and agree a fair amount with the rider. If there is a dispute, preserve the ride reference and contact support.

7. KW3LA platform fee and commission account

KW3LA charges the platform fee displayed in Driver Home on completed rides. The current pilot rate is 10%. Completed rides create a debit in your KW3LA commission account. Prepayments/credits and payment confirmations may create credits.

Your account may operate within the credit/debt limit shown in Driver Home. Once the configured limit is reached, KW3LA may prevent you from going available for another ride until sufficient payment is confirmed. We will not interrupt an active ride solely because the commission threshold is reached.

For the Zimbabwe launch, authorised cash collection is the baseline settlement method. An authorised agent records the cash in KW3LA Commission Ops and the driver receives a unique digital receipt; the commission account is credited only when that database transaction commits. Do not hand cash to anyone who cannot provide the KW3LA receipt reference while you are present.

Digital settlement rails are optional and are available only when Driver Home shows them as enabled. Where USDC on Solana is enabled, use only the exact network, token, amount and payment request shown by KW3LA. A USDC payment is credited only after KW3LA verifies a finalized on-chain transaction. Never share a wallet recovery phrase or private key with KW3LA or an agent. EcoCash, bank and card rails shown as under development must not be used until enabled.

8. Cancellations and rider choice

Our Cancellation & Refund Policy applies. You may cancel before trip start for legitimate safety, vehicle, route, capacity or operational reasons. You must not cancel or refuse service for an unlawful discriminatory reason.

A rider may cancel if they do not wish to travel in the matched vehicle or with the matched driver, including where identity does not match or they feel unsafe. During the launch pilot KW3LA does not charge a rider cancellation fee.

9. Safety, conduct and communications

Harassment, violence, sexual misconduct, threats, discrimination, fraud, retaliation and misuse of personal information are prohibited. Do not type messages while driving; use quick status controls where safe, or stop safely before interacting with the app.

Never represent that KW3LA can dispatch emergency services. In an immediate emergency, contact the appropriate local emergency service.

10. Taxes, costs and insurance

You are responsible for your own fuel, maintenance, device/data costs, licences, permits, vehicle costs, taxes and other obligations arising from your transport activity except where law requires otherwise. You must maintain legally sufficient insurance for the service you perform and must disclose ride-hailing/passenger-for-reward activity to an insurer where required.

11. Suspension and removal

KW3LA may suspend availability, require re-review or remove driver access where reasonably necessary for safety, suspected fraud, legal non-compliance, expired/inaccurate vehicle information, serious complaints, commission non-payment, misuse of personal data or material breach. Where appropriate, we may request documents or an explanation before restoring access.

12. Records, privacy and investigations

Driver identity, vehicle details, ride lifecycle, messages, location, commission ledger and payment-claim records are processed as described in the Privacy Notice. You must cooperate reasonably with lawful safety investigations and preserve relevant information. You must not independently publish a rider's personal information or ride history.

13. Changes, termination and law

You may stop using KW3LA at any time, but amounts already due and obligations relating to completed rides, safety incidents and lawful records survive termination. KW3LA may update these terms and require renewed acceptance.
